Define Truckers General Liability
SynchronoSure®’s Truckers Commercial General Liability is a casualty insurance that covers the liability exposures involving third party bodily injury and damage to property of a small trucking business that are not directly related to the operation of the truck. For example, if a member of the public is on your premises, either in your garage, yard or office and somehow they sustained bodily injury or property damage, your Automobile Liability Insurance would provide neither defense nor indemnity for this type of occurrence. Your Auto Liability Insurance only covers relating to the use of your trucks or other autos Your Truckers Commercial General Liability policy addresses your other liability exposures not related to the use or operation of your trucks and other autos.
Your Truckers General Liability coverage can cover your trucking business operations both on your premises or off premises when your employees are on someone else’s premises while involved in work-related activities.
Our Truckers Commercial General Liability Enhancement Endorsement includes additional itemized coverage specific to the needs of your trucking business. This endorsement makes minor changes in the original policy to enhance the insurance coverage. The endorsement is subject to the provisions of the policy, which means that it is subject to all limitations and conditions applicable to the Coverage Form unless specifically deleted, replaced, or modified therein.
Below are the changes on the Truckers Commercial General Liability policy provisions provided on the endorsement.
No Property Damage Coverage on Borrowed Equipment
The policy provisions for damage to property does not apply to borrowed equipment that is not being used for business operations at the site. In addition, the endorsement is excess over any of the other insurance, whether primary, excess, contingent or on any other basis, that is property insurance.
Broadened Personal Injury and Advertising Injury
The definition of “Personal and Advertising Injury” has been changed to injury, including consequential bodily injury, arising out of one or more of the following offenses:
- False arrest, detention, or imprisonment
- Malicious prosecution or abuse of process
- The wrongful eviction from, wrongful entry into, or invasion of the right of private occupancy of a room, dwelling or premises that a person occupies, committed by or on behalf of its owner, landlord or lessor
- Slander or libel against a person, organization, or business’ goods, products, or services
- Violation against a person’s right of privacy
- Copyright infringement
The exclusions for this liability coverage are also modified to pertain to materials published with the knowledge of falsity and materials published prior to policy period.
Property Damage Legal Liability
In the Limits of Insurance section of the Declarations page of the policy, the term “fire” has been changed to “fire, lightning, explosion, smoke or leakage from fire protective system.”
The policy does not provide for the damages caused by fire-related hazards to workplaces that are rented by the policyholder or temporarily occupied but with the permission of the premises’ owner. However, there are certain limits to all damage proximately caused by the same event, whether such damage results from fire, lightning, explosion, smoke, or leakage from fire protective systems or any combination of the five.
The coverage for policyholders who rent or temporarily occupy a workspace with the permission of the owner has increased limits from the standard $50,000 shown on the policy $500,000.
Medical Payment Limit of Insurance
The Medical Expense Limit is increase to $5,000.
Extended Supplementary Payments
The supplementary payments of $250 is changed to $2,500. And the payment of $250 a day is changed to $500 a day.
Blanket Waiver of Subrogation
SynchronoSure® waives the right to sue a person or organization because of payment made for injury or damage arising out of premises owned, occupied, rented, or loaned to the policyholder, as well as the ongoing operations done by the business or on its behalf. We waive this right only where the policyholder has agreed to do so as part of a written contract, executed by its prior to loss.
Automatic Additional Insureds
The policyholder can add any person(s) or organization(s) so long as it has been agreed upon in a contract or agreement that such person(s) or organization(s) be added as an additional insured on your policy. Such person(s) or organization(s) is an additional insured only for damages:
1. Which are covered by this insurance; and
2. Which the policyholder has agreed to provide in such contract or agreement subject to the following provisions:
- The ownership, maintenance or use of that part of the premises or land, owned by, rented to, or leased to the policyholder;
- The policyholder’s ongoing operations performed for such person(s) or organization(s)
- Such person(s) or organization(s) financial control of the policyholder; or
- A state or political subdivision permit issued to the policyholder.
The insurance coverage does not apply to any occurrence or offense which took place before the execution of, or after the completion or expiration of, the written contract or agreement or which takes place after the insured ceases to be a tenant in that premises.
The coverage for bodily injury, property damage, or personal and advertising injury does not apply to the failure of any professional services by the business or any hired engineer, architect, or surveyor. The professional services include the following: preparing, approving, or failing to prepare or approve, maps, shop drawings, opinions, reports, surveys, field orders, change orders or drawings and specifications; and supervisory, inspection, architectural or engineering activities.
Reasonable Force Resulting to Bodily Injury or Property Damage
The bodily injury or property damage of the insured resulting from the use of reasonable force to protect people or properties is covered by the policy, subject to terms and conditions.
Knowledge of Occurrence, Offense, Claim or Suit
The knowledge of an occurrence, offense, claim, or suit by an agent, servant or employee of any insured shall not in itself constitute knowledge of the insured. It is unless the insured listed receives direct reports of such notice from the agent, servant, or employee.
Shall there be any revisions in this endorsement to provide more coverage without an additional premium charge, SynchronoSure® will automatically provide the additional coverage to all endorsement holders as of that day.
Primary and Noncontributory
Primary and Noncontributory insurance coverage is added to the policy for any additional insured, provided that:
- The additional insured is a Named Insured under such other insurance; and
- The policyholder has agreed in writing in a contract or agreement that this insurance would be primary and would not seek contribution from any other insurance available to the additional insured.
